DESCRIPTION:MTA WA is pleased to invite Dealer Principals to an exclusive breakfast discussion focused on key issues impacting WA’s dealer community. \nThis session will provide a valuable opportunity to ask questions and gain insights specifically relating to \n\nVehicle Salespersons commissions and entitlements under Federal Vehicle Award and\nAustralian Consumer Law\n\nWhen: Tuesday 21st July \nTime: 7:00am – 9:30am \nVenue: Fraser’s Kings Park \nEvent Details: \nAttendance is strictly limited to MTA WA members and capped at 50 participants to ensure an interactive and productive discussion environment. \nAs this is a member-only event\, tickets are complimentary; however registration is essential to secure your place. \nWe encourage early reigstraion to avoid disappointment. \nMore about the speakers and topics below; \nSean Foy is a Senior Associate at Panetta McGrath specialising in Employment and Workplace Relations. \nVehicle Salespersons are commonly incentivised and paid to increase sales by way of commissions.  Under these arrangements their total remuneration package can be extremely generous.  However\, vehicle salespersons are also subject to the Vehicle Repair\, Services and Retail Award (the VRSR Award) which imposes obligations on how commissions are paid and also creates other legal entitlements.  The interaction with the Award can often give rise to a number of important questions: \n\nWhat rights and obligations does the award create when a commission is agreed\nWhat award entitlements can be set off by commissions (such as retainers)?\nWhen drafting commission agreements what should dealerships be careful of?\nWhen vehicle salespersons go on leave is an average commission payable?\n\nSean will discuss these issues and provide practical advice on how to deal with commission related problems arising under the Award. \nJohn McMaster is the General Manager of Conciliation and Trader Intervention at Department of Local Government\, Industry Regulation and Safety (LGIRS) \nJohn will discuss \n\nMost common cases lodged with Consumer Protection against dealers and statistics\nThe steps CP takes following a case lodgement (automated\, engagement and advice)\nWhat steps can a dealer take if a customer’s claim is unreasonable\, and still assist with the conciliation process\n\nEvan Stents is the Victorian State Group Head of Litigation and specialises in Dispute Resolution and Insolvency at HWLE Lawyers. \nEvan’s special expertise is in the Automotive and Franchising industries\, working with commercial agreements\, property and leasing disputes\, Corporations Law applications\, Restrictive Trade Practices\, injunctions and Administrations\, Receiverships and Liquidations. \nEvan is considered one of the leading Automotive lawyers in Australia and is a qualified mediator.
